Section 1. Products to which this limited warranty appliesThis limited warranty applies to your newlypurchased Dimplex electric fireplace. Thislimited warranty applies only to purchasesmade in any province of Canada exceptfor Yukon Territory, Nunavut, or NorthwestTerritories or in any of the 50 States of theUSA (and the District of Columbia) exceptfor Hawaii and Alaska. This limited warrantyapplies to the original purchaser of theproduct only and is not transferable.Products excluded from this limited warrantyLight bulbs are not covered by this limitedwarranty and are the sole responsibility ofthe owner/purchaser. Products purchasedin Yukon Territory, Nunavut, NorthwestTerritories, Hawaii, or Alaska are not coveredby this limited warranty. Products purchasedin these States, provinces, or territories aresold AS IS without warranty or conditionof any kind (including, without limitation,any implied warranties or conditions ofmerchantability or fitness for a particularpurpose) and the entire risk of as to thequality and performance of the products iswith the purchaser, and in the event of adefect the purchaser assumes the entire costof all necessary servicing or repair.
Section 2. What this limited warranty covers and for howlongProducts, other than fireplace surrounds(mantels) and trims, covered by this limitedwarranty have been tested and inspectedprior to shipment and, subject to theprovisions of this warranty, Glen DimplexAmericas Ltd. (herein called Glen DimplexAmericas) warrants such products to be freefrom defects in material and workmanship fora period of 2 years from the date of the firstpurchase of such products.Glen Dimplex Americas fireplace surrounds(mantels) and trims covered by this limitedwarranty have been tested and inspectedprior to shipment and, subject to the provisions of this warranty, Glen DimplexAmericas warrants such products to be freefrom defects in material and workmanshipfor a period of 1 year from the date of firstpurchase of such products.The limited 2 year warranty period forproducts other than fireplace surrounds(mantels) and trims and the limited 1 yearwarranty period for fireplace surrounds(mantels) and trims also applies to anyimplied warranties that may exist underapplicable law. Some jurisdictions do notallow limitations on how long an impliedwarranty lasts, so the above limitation maynot apply to the purchaser.
Section 3. What this limited warranty does not coverThis limited warranty does not apply toproducts that have been repaired (exceptby Glen Dimplex Americas or its authorizedservice representatives) or otherwise altered.This limited warranty does further not applyto defects resulting from misuse, abuse,accident, neglect, incorrect installation,improper maintenance or handling, oroperation with an incorrect power source.
Section 4. What you must do to get service under thislimited warrantyDefects must be brought to the attention ofTechnical Service at 1-888-346-7539. Pleasehave proof of purchase, catalogue/model andserial numbers available when calling. Limitedwarranty service requires a proof of purchaseof the product.What Glen Dimplex Americas will do in theevent of a defectIn the event a product or part covered by thislimited warranty is proven to be defective inmaterial or workmanship during (i) the 2 yearlimited warranty period for products otherthan fireplace surrounds (mantels) and trims,and (ii) the 1 year limited warranty period forsurrounds (mantels) and trims, you have thefollowing rights:
- Glen Dimplex Americas will in its solediscretion either repair or replace suchdefective product or part without charge. If Glen Dimplex Americas is unable torepair or replace such product or part, or ifrepair or replacement is not commerciallypracticable or cannot be timely made, GlenDimplex Americas may, in lieu of repairor replacement, choose to refund thepurchase price for such product or part.
- Limited warranty service will be performedsolely by dealers or service agents of GlenDimplex Americas authorized to providelimited warranty services.
- For products other than surrounds(mantels) and trims, this 2 year limitedwarranty entitles the purchaser to on-siteor in-home warranty services. Accordingly,Glen Dimplex Americas will be responsiblefor all labour and transportation associatedwith repairing or replacing the product orpart except as follows: (i) charges whichmay be levied for travel costs incurred totravel to the purchaser’s site where theproduct is located if the purchaser’s site isbeyond 30 miles (48 km) from the closestservice depot of Glen Dimplex Americasdealer or service agent; and (ii) thepurchaser is solely responsible for providingclear access to all serviceable parts of theproduct.
- For surrounds (mantels) and trims, this 1year limited warranty does not entitle thepurchaser to on-site or in-house warrantyservices. The purchaser is responsible forremoval and transportation of the surrounds(mantels) and trims (and any repaired orreplacement product or part) to and fromthe authorized dealer’s or service agent’splace of business. On-site or in-homeservices for surrounds (mantels) and trimsmay be performed at the purchaser’sspecific request and expense at GlenDimplex Americas then current rates forsuch services. Glen Dimplex Americaswill not be responsible for, and this limitedwarranty shall not include, any expenseincurred for installation or removal of thesurrounds (mantels) or trims or any partthereof (or any replacement product or part) including, without limitation, all shippingcosts and transportation costs to and fromthe authorized dealer’s or service agent’splace of business and all labour costs. Suchcosts shall be the purchaser’s responsibility.
Section 5. What Glen Dimplex Americas and its dealersand service agents are also not responsiblefor:IN NO EVENT WILL GLEN DIMPLEXAMERICAS, OR ITS DIRECTORS,OFFICERS, OR AGENTS, BE LIABLE TOTHE PURCHASER OR ANY THIRD PARTY.WHETHER IN CONTRACT, IN TORT, OR ONANY OTHER BASIS, FOR ANY INDIRECT,SPECIAL, PUNITIVE, EXEMPLARY,CONSEQUENTIAL, OR INCIDENTAL LOSS,COST, OR DAMAGE ARISING OUT OFOR IN CONNECTION WITH THE SALE,MAINTENANCE, USE, OR INABILITY TOUSE THE PRODUCT, EVEN IF GLENDIMPLEX AMERICAS OR ITS DIRECTORS,OFFICERS, OR AGENTS HAVE BEENADVISED OF THE POSSIBILITY OF SUCHLOSSES, COSTS OR DAMAGES, OR IFSUCH LOSSES, COSTS, OR DAMAGESARE FORESEEABLE. IN NO EVENT WILLGLEN DIMPLEX AMERICAS, OR ITSOFFICERS, DIRECTORS, OR AGENTSBE LIABLE FOR ANY DIRECT LOSSES,COSTS, OR DAMAGES THAT EXCEED THEPURCHASE PRICE OF THE PRODUCT.SOME JURISDICTIONS DO NOT ALLOWTHE EXCLUSION OR LIMITATION OFINCIDENTAL OR CONSEQUENTIALDAMAGES, SO THE ABOVE LIMITATIONOR EXCLUSION MAY NOT APPLY TO THEPURCHASER.
Section 6. How State and Provincial law applyThis limited warranty gives you specific legalrights, and you may also have other rightswhich vary from jurisdiction to jurisdiction. Theprovisions of the United Nations Conventionon Contracts for the Sale of Goods shall notapply to this limited warranty or the sale ofproducts covered by this limited warranty.
